Abstract
Today we live in a society based on knowledge, in which information is an instrument of economic development, an engine of innovation. Innovation is a source of competitiveness. What is the role of the legislation in the innovation process? Market failures lead to over- or underinvestment in innovation. Different policy actors working together can contribute to the creation of the most optimal policy for specific innovation systems. Regulators on different levels (national, regional) should use instruments for correcting the market failures, considering the threat of possible state failure. Small transition countries, with their own characteristics, require policy modeled on their own needs, which will promote innovation and bring them forward in the global market.
